Fitness Footwear Terms & Conditions
Here's a quick rundown of all our legal terms and conditions. Sorry to be so formal, but this information is here to protect you, the Customer, and us, the Supplier.
All of our terms and conditions apply to the use of this Website and by accessing this Website and/or placing an order you agree to be bound by the terms and conditions set out below.
If you do not agree to be bound by these terms and conditions you may not use or access this Website.
1. Your Contract with us
In order to purchase Products from the Fitness Footwear website you must be over eighteen years of age. There will be no contract of any kind between you and Fitness Footwear unless, and until, we despatch the Product to you.
At any point up until then, Fitness Footwear may decline to supply the Product to you. When the Product is despatched, a contract will be made between you and Fitness Footwear as agreed in these terms of use. You will be charged for the Product once your order has been placed.
2. Prices
The prices payable for the Products that you order are clearly set out on the Site. If, in error, Fitness Footwear has underpriced a Product, Fitness Footwear will not be liable to supply that Product to you at the stated price, provided that Fitness Footwear notifies you before Fitness Footwear despatches the Product concerned. All prices displayed are inclusive of VAT unless otherwise stated.

4. Delivery
Delivery will be made to the address specified by you on the completed order form. Please note that we only ship within the United Kingdom, West Europe and East Europe. We aim to despatch all orders (subject to availability) between 1 - 10 days from receipt of your order. All goods should be delivered within two weeks from despatch. Fitness Footwear will not be responsible for non delivery of goods unless we are notified within 30 days of despatch. Fitness Footwear shall not be liable for loss resulting from delay in delivery arising out of any cause beyond its control. In the unlikely event of a delay, we will advise you accordingly.
5. Cancellation
You have the right to cancel your order up to 7 working days after the day following the delivery of the Products.
In the event that the Product has already been despatched at the date of receipt of your cancellation of the order you must return the Product to Fitness Footwear. Upon receipt of the goods, Fitness Footwear will immediately credit your credit or debit card with the price of the Product.
If you do not return the Products within 30 days of your notice of cancellation, you will be deemed to have accepted them. This does not affect your statutory rights and you will still be entitled to an exchange, but not a refund.
6. Returns
If you are returning a Product due to an error on the part of Fitness Footwear or because it is faulty, you must contact us in advance.
For your protection, we recommend that you ask for proof of postage from your local post office and send your shoes as cheaply as possible in case you cannot be refunded.
Fitness Footwear carefully inspects all products returned as faulty and it is at Fitness Footwear's discretion whether or not a refund or exchange is given.
As such, you will be responsible for the costs of returning any Products unless Fitness Footwear finds that the goods have been delivered to you in error or the Product is faulty on delivery and returned unworn.
In addition to your right to cancel above, Fitness Footwear will accept most returned products for an exchange within 30 days of receipt as long as they are unworn, unused and in their original packaging.However, we are only able to exchange items where a different size/colour of the same item is requested.
If goods are returned dirty, worn or well used and/or not in their original packaging, or the packaging has been damaged or defaced to make the product unsellable, Fitness Footwear will decline a refund or exchange and you will be liable for the cost to have your shoes returned to you. 7. Payment
We take payment in Pounds Sterling (GBP) with Mastercard or Visa credit card or debit card. Your credit/debit card details will be encrypted to avoid the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of order.
8. Disclaimer of Liability
The Fitness Footwear Website is provided without any warranties or guarantees to the extent permitted by law.
In particular, we do not warrant that the Fitness Footwear Site or any of its contents is virus free. You must take your own precautions in this respect as we accept no responsibility for any infection by virus or other contamination.
While we do our best to provide constant access to the Fitness Footwear Site, we cannot guarantee this and accept no responsibility or liability for any interruption or delay in the service of our website.
Fitness Footwear confirms that every effort has been made to ensure that material included on the Fitness Footwear Site is correct and that the Products offered are of good quality, but cannot accept responsibility if this is not the case and, as stated above, we disclaim all liability in respect of the Products.
Nothing in these terms of use shall exclude the customer's liability for personal injury or death caused by negligence.
If any inconsistencies in the details of Fitness Footwear procedures arise, these Terms and Conditions will always take precedence.
9. Data Protection
All information received for your use of the Fitness Footwear Site will be used in accordance with the Privacy Policy and be made accessible to the software host for the Fitness Footwear Site, our order processing centre and the credit card merchant service provider in order to facilitate your purchase.
10. Use of Material on the Fitness Footwear Website
All material including text, video, graphics and sound material published on the Fitness Footwear Site may not be reproduced on the web or in print unless we have indicated that you may do so.
However, you may download and print extracts from the material and make copies of these for your own personal and non-commercial use only.
11. Amendments
We may amend these terms and conditions from time to time by posting revised terms and conditions on the site. These revisions will apply to all orders placed after such date.
12. Notices
All notices shall be given by email to sales@fitnessfoootwear.com or shall be given by email to you at either the email or postal address you provide during the registration process. Notice will be deemed received 24 hours after e-mail is sent or three days after the date of posting.
13. Governing Law & Jurisdiction
This agreement is governed by English law and the parties agree to submit to the exclusive jurisdiction of the English courts.
